Hello and welcome to our website. The purpose of this site is to help generate funds to preserve our rights to use a beach that has been maintained and enjoyed by the homeowners of Villa Rica Club since 1891.
In 2006, a lawsuit was filed against the homeowners of Villa Rica by the property owners to the east of the Villa Rica, or community beach.
The lawsuit requested the court to:
1. Declare that the community beach belonged to this plaintiff.
2. Declare that the residents of Villa Rica Club have no interest, ownership, or rights to the waterfront property to the west of the plaintiffs home.
3. Award the plaintiff damages for expenses incurred as a result of their lawsuit against Villa Rica; also adding punitive damages of $25,000.00 for Villa Rica's "willful and wanton conduct." (Using the beach)
Interestingly, the plaintiff was the first to claim ownership of this beach since the properties first conveyance in 1919. Previous owners of the plaintiffs' property freely admitted that the beach was owned by the Villa Rica Community, and was not included on their property deed.
To date the Villa Rica has spent nearly $30,000.00 on title searches, surveys, and attorney fees to prove our ownership, and protect our interest in this property.
Unfortunately, the costs to continue to defend our beach are escalating quickly, and it has become quite difficult to keep up with them. We are also between a rock and a hard place, and have no choice but to continue through the court system to defend the rights to use this property.
If we default now, the money that has been invested to fight this lawsuit will have been in vain. We will lose the beach that we have cared for for over 100 years, and we will also lose the $25,000.00 in court costs that the plaintiffs have demanded.
This has been a very expensive process and we are currently in arrears to our attorney for over $8,000.00.
The good news is that we are in the final stretch. A trial date has been set for January 4, 2010, and the evidence to support our case is very good. We need to press on toward the goal and keep our eyes on the prize!
